Three employers fined for breaching MPFS Ordinance

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

     Three employers were fined $13,800 at the Kwun Tong Magistracy today (December 1), after being convicted of offences under the Mandatory Provident Fund Schemes Ordinance (Cap. 485).

     Cheung Tak Ming trading as Ho Sang Printing Co was charged for an offence under section 7A(8) of the ordinance. The defendant pleaded guilty to nine counts of failing to make Mandatory Provident Fund (MPF) contributions for its employee within the prescribed time for the contribution periods between April and December 2006. The defendant was fined $1,000 for each summons, together with the costs of $200 for each summons, totalling $10,800.

     Lodco Engineering Services Company Limited was charged for an offence under section 7A(8) of the ordinance. The defendant pleaded guilty to a count of failing to make an MPF contribution for its employee within the prescribed time for the contribution period in February 2008. The defendant was fined $1,000 for the summons. The defendant also pleaded guilty to an offence under section 7(1) of the ordinance and was fined $1,000 for failing to enroll its employee in an MPF scheme as required by the ordinance. The two summonses totalled $2,000.

     Apple Green Limited formerly known as Uni-Pac International Real Estate Consultants Ltd pleaded guilty to an offence under section 7(1) of the ordinance. The defendant was fined $1,000 for the summons for failing to enroll an employee in MPF scheme as required by the ordinance.

     Meanwhile, the Mandatory Provident Fund Schemes Authority (MPFA) today also pursued three claims in the Small Claims Tribunal for some $28,000 on behalf of 34 employees, who were owed MPF contributions by their employers.

     At the tribunal's hearing today, three defendants, namely Wai Lung Plastic MFY Limited, Universal Treasure Development Limited trading as Chuk Yuen Vietnamese Restaurant and Yeung Kwok Hung trading as Sun Wah Yan Restaurant, did not appear. In their absence, the adjudicator ordered them to pay the MPFA the sums of $26,529.78, $1,767.5 and $467.58 respectively, being mandatory contributions in arrears and surcharges payable.

     The amounts awarded at the tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The tribunal further ordered the respective defendants to pay $126, $140 and $150 as the costs in respect of the claims.
