The Mandatory Provident Fund Schemes Authority (MPFA) today (November 28) obtained one order for payment of outstanding MPF contributions at about $50,000 against one employer in the District Court. The MPFA today also pursued five claims in the Small Claims Tribunal for some $100,000 on behalf of 18 employees, who were owed MPF contributions by their employers.
The District Court today issued a judgment against one employer, Masaka Japanese Restaurant Limited trading as Masaka Japanese Restaurant. The defendant was ordered to pay the MPFA the sum of $54,848.22, being mandatory contributions in arrears and surcharges payable to 12 employees of the defendant.
At the tribunal's hearing today, the four defendants, namely The Beauty School Limited, Chan Shu Wah trading as Wai Tai Hong, Colour World International Limited and Wah Yuen Property Agents Company Limited, did not dispute the amounts claimed. The Adjudicator ordered them to pay the MPFA the sums of $39,507.23, $17,720.02, $10,920.34 and $3,629.64, being mandatory contributions in arrears and surcharges payable.
Meanwhile, another defendant, Chan Fai Hung trading as Sun Wui Tung Shipping Co., did not appear at today's hearing. In his absence, the adjudicator ordered him to pay the MPFA the sum of $31,389.57, being mandatory contributions in arrears and surcharges payable.
The amounts awarded at the District Court and the tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court ordered the defendant to pay costs of $930. The tribunal ordered the respective defendants to pay $256, $200, $106, $120 and $120 as the costs in respect of the claims.
