Five employers fined for breaching MPFS Ordinance

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority (MPFA):

     Five employers were fined $27,000 at the Kwun Tong Magistracy today (November 4), after being convicted of offences under the Mandatory Provident Fund Schemes Ordinance (Cap. 485).

     Elique Limited was charged under section 7A(8) of the ordinance and pleaded guilty to 10 counts of failing to make MPF contributions for an employee within the prescribed time for the contribution periods between April 2007 and Jan 2008. The defendant was fined a total of $12,000.

     Talisgold International Limited was charged under section 7A(8) and pleaded guilty to five counts of failing to make MPF contributions for an employee within the prescribed time for the contribution periods in October 2007 and between December 2007 and March 2008. The defendant was fined a total of $5,000.

     Kwok Nga Yin trading as Dawnlite Creation was charged under section 7A(8) and pleaded guilty to three counts of failing to make MPF contributions for an employee within the prescribed time for the contribution periods between January and March 2008. The defendant was fined a total of $3,000.

     C F International Group Limited pleaded guilty to an offence under section 7(1) of the ordinance and was fined $4,000 for failing to enrol an employee in MPF scheme.

     Profit Wise (HK) Limited pleaded guilty to an offence under section 7(1) of the ordinance and was fined $3,000 for failing to enrol an employee in MPF scheme.

     The MPFA today also pursued three claims in the Small Claims Tribunal for about $63,000 on behalf of eight employees, who were owed MPF contributions by their employers.

     Two defendants, Fidelity Concept Development Limited trading as Royal Plaza Restaurant and Plenty Profit Holdings Limited trading as Lucky Fellow Restaurant, did not dispute the amounts claimed. The Adjudicator ordered them to pay the MPFA $28,384.22 and $10,618.65, being mandatory contributions in arrears and surcharges payable.

     Alliance (Fast East) Holdings Limited, did not appear at today¡¦s hearing and was ordered to pay the MPFA $23,546.32, being mandatory contributions in arrears and surcharges payable.

     The amounts awarded at the tribunal will be reimbursed to the employees¡¦ MPF accounts as soon as they are received by the MPFA. The tribunal ordered the respective defendants to pay costs of $120, $90 and $245.

     Alliance (Fast East) Holdings Limited and Plenty Profit Holdings Limited trading as Lucky Fellow Restaurant pleaded guilty previously at Kwun Tong Magistracy to 28 and 20 counts of failing to make MPF contributions on time and were fined $40,400 and $32,500 respectively.

     Hoi On Security Company Limited also pleaded guilty previously at Kwun Tong Magistracy to a count of failing to enrol its employee in an MPF scheme and was fined $8,000.
