The Telecommunications Authority (TA) today (September 3) served a notice to Citizens' Radio to direct it to immediately cease its use of radio transmitter which had been found to have caused interference to the communication channels of the Civil Aviation Department (CAD).
"OFTA received a complaint from CAD on August 27 about interference from a broadcasting signal to the air-ground communication channels for use in civil aviation services. We then immediately initiated an investigation. Following a series of in-depth investigation and collection of evidence, including a sound recording provided by CAD on September 2, it has been discovered that the source of interference originated from Citizens' Radio. As the interference may pose potential hazard to aircraft operation, the TA therefore issued a notice today to Citizens' Radio to direct it to immediately cease its use of radio transmitter under section 32J of the Telecommunications Ordinance (TO)," a spokesperson of OFTA said.
The spokesperson added that "under section 32J of the TO, any person who, knowingly and without lawful excuse, uses an apparatus in a manner that causes harmful interference with any other lawful telecommunications services or apparatus, shall be guilty of an offence and shall be liable to a fine of $50,000 and to imprisonment for 6 months."
"OFTA would monitor the situation closely and take enforcement action as appropriate if Citizens' Radio fails to comply with the notice by ceasing its use of radio transmitter," the spokesperson warned.
