Company director and employer fined for breaching MPFS Ordinance

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

     A company director and an employer were fined a total of $19,600 at the Kwun Tong Magistracy today (September 1), after being convicted of offences under the Mandatory Provident Fund Schemes Ordinance (Cap. 485).

     Lau Yuk Por, director of Waycon International Limited, was charged with offences under section 7A(8) and section 44 of the Ordinance. The defendant pleaded guilty to five counts of failing to make MPF contributions for an employee within the prescribed time for the contribution period between December 2007 and April 2008. The defendant was fined $5,000 for the first summons and $1,200 each for the remaining summonses, totaling $9,800.

     Waycon International Limited was also charged under section 7A(8) of the ordinance. The defendant pleaded guilty to five counts of failing to make MPF contributions for an employee within the prescribed time for the contribution periods between July and November 2007. The defendant was fined $5,000 for the first summons and $1,200 each for the remaining summonses, totaling $9,800.

     The MPFA today also pursued two claims in the Small Claims Tribunal for about $7,500 on behalf of two employees, who were owed MPF contributions by their employers.

     Defendants Chan Chi Chuen trading as Lawson Trading Company and Ginwave Technologies (HK) Limited, did not appear at today¡¦s hearing and in their absence, the Adjudicator ordered them to pay the MPFA $6,668.98 and $840, being mandatory contributions in arrears and surcharges payable.

     The amounts awarded at the tribunal will be reimbursed to the employees¡¦MPF accounts as soon as they are received by the MPFA. The tribunal further ordered the respective defendants to pay costs of $250 and $101.
