Eight employers ordered to pay MPF non-payment

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

    The Mandatory Provident Fund Schemes Authority (MPFA) today (July 2) obtained one order for payment of outstanding MPF contributions at about $81,000 against an employer in the District Court. Meanwhile, the MPFA pursued five claims in the Small Claims Tribunal for some $140,000 on behalf of 17 employees, who were owed MPF contributions by their employers.

    The District Court today issued judgment against one employer, namely, Painting International Beauty Limited. The defendant was ordered to pay the MPFA the sum of $81,513.2, being mandatory contributions in arrears and surcharges payable to nine employees of the defendant.

    Meanwhile, at the Tribunal's hearing today, two defendants, including United Business Printing Limited and Hui Hong Por trading as Yat Luen Engineering Co, did not dispute the amount claimed. The Adjudicator ordered them to pay the MPFA the sum of $42,897.22 and $31,521.06, being mandatory contributions in arrears and surcharges payable.

    The other three defendants, including Fidelity Concept Development limited trading as Royal Plaza Restaurant, Plenty Profit Holdings Limited trading as Lucky Fellow Restaurant and Hongkong Bright Holdings Limited trading as Royal Plaza Court Seafood Restaurant, did not appear at today¡¦s hearing. In their absence, the Adjudicator ordered them to pay the MPFA the sums of $30,070.78, $27,323.88 and $8,748.17, being mandatory contributions in arrears and surcharges payable.

    On the other hand, at Tribunal's hearing previously, the defendant, Samca Industrial Limited, did not dispute the amount claimed. The Adjudicator ordered it to pay the MPFA the sum of $5,510, being mandatory contributions in arrears.

    In addition, the High Court issued a judgment previously against Hin Sum Manpower Company Limited. The defendant was ordered to pay the MPFA the sum of $2,639,838.86, being mandatory contributions in arrears and surcharges payable to 118 employees of the defendant.

    The amounts both awarded at the District Court and the Tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court ordered the defendant to pay cost of $930. The Tribunal ordered the respective defendants to pay $160, $190, $120, $222, $176 and $120 as the costs in respect of the claims, while the High Court ordered the defendant to pay cost of $1,550.

    Plenty Profit Holdings Limited trading as Lucky Fellow Restaurant and Hongkong Bright Holdings Limited trading as Royal Plaza Court Seafood Restaurant pleaded guilty previously at Kwun Tong Magistracy to 20 and 7 counts of failing to make MPF contributions on time and was fined $32,500 and 18,000 respectively.
