Nine employers ordered to pay MPF non-payments

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

    The Mandatory Provident Fund Schemes Authority (MPFA) today (May 15) obtained five orders in the District Court for payment of outstanding MPF contributions at about $730,000 against five employers. The MPFA also pursued three claims in the Small Claims Tribunal for about $110,000 on behalf of nine employees, who were owed MPF contributions by their employers.

    The District Court today issued judgment against five employers - Loyal Cheer Investment Limited, IS Master Company Limited, Liaqat Ali trading as Shaffi's Indian Restaurant (formerly known as Shaffi's Indian Restaurant), Wah Fai Logistics Limited and James Young & Company Limited trading as Intercontinent Mercantile Company. The defendants were ordered to pay the MPFA $252,998.52, $236,398, $137,016.79, $84,488.52 and $32,344.82 being mandatory contributions in arrears and surcharges payable to 19, 5, 9, 6 and 10 employees of the defendants respectively.

    At the tribunal's hearing, the defendant, Classic Perfect Production Co. Limited, did not dispute the amount claimed. The Adjudicator ordered it to pay the MPFA $42,655, being mandatory contributions in arrears and surcharges payable.

    The other two defendants, Wah Fai Logistics Limited and Data-form Engineering Limited, did not appear. In their absence, the Adjudicator ordered them to pay the MPFA $48,561.75 and $28,757.81, being mandatory contributions in arrears and surcharges payable.

    The District Court earlier issued judgment against Tang Tung Leung trading as (Lo Kwok Leung formerly trading as) Kam Fook Engineering Co. The defendant was ordered to pay the MPFA $668,116.05, being mandatory contributions in arrears and surcharges payable to 36 employees.

    The amounts both awarded at the District Court and the tribunal will be reimbursed to the employees¡¦ MPF accounts as soon as they are received by the MPFA. The District Court ordered the defendants to each pay costs of $930. The tribunal ordered the respective defendants to pay costs of $156, $140 and $106.
