Eleven employers ordered to pay MPF non-payments

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

    The Mandatory Provident Fund Schemes Authority (MPFA) today (February 13) obtained orders in the District Court for payment of outstanding MPF contributions at about $383,000 against three employers. The MPFA also pursued eight claims in the Small Claims Tribunal for some $174,400 on behalf of employees, who were owed MPF contributions by their employers.

    The District Court issued judgements against
Winitex Enterprises Limited, Cheuk Hing Yuen trading as Hit Team Express and Fook Kee Plastic Metal Manufactory Company Limited. The defendants were ordered to pay the MPFA $52,126.15, $180,822.12 and $150,234.18, being mandatory contributions in arrears and surcharges payable to 13, 35 and five employees of the defendants respectively.

    At the tribunal's hearing, three defendants - Cheng Ping Hon trading as Fuhan China-HK Transportation (HK) Co, Sunny International Trade Limited and Multi Tone Hong Kong Development Limited trading as Man Ho Seafood Restaurant - did not dispute the amounts claimed. The Adjudicator ordered them to pay the MPFA $30,641.49, $37,271.25 and $13,596.34, being mandatory contributions in arrears and surcharges payable.

    The other five defendants, Fiona Underwear Company Limited, Brilliant Smart Engineering Limited, Racket Head Limited, Ying Feng Decoration Co Limited and Ma Chung Kan and Ng Sze Yan trading as Nam Fung Restaurant, did not appear. In their absence, the Adjudicator ordered four of them to pay the MPFA $2,182.80, $37,327.16, $46,962.69 and $5,116.16, being mandatory contributions in arrears and surcharges payable. Ma Chung Kan and Ng Sze Yan trading as Nam Fung Restaurant was ordered to pay MPFA $1,391.95, the surcharge payable.

    The amounts both awarded at the District Court and the tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court ordered the defendants to each pay costs of $930 and the tribunal ordered the respective defendants to pay costs of $90, $140, $90, $120, $160, 186, $156 and $150.
