Hung Kin Engineering was fined $80,000 at the Kowloon City Magistrates' Courts today (December 31) for violation of the Factories and Industrial Undertakings Ordinance. The prosecution was launched by the Labour Department.
The case involved a fatal accident on May 9 at a construction site in To Kwa Wan. A worker was electrocuted when he was holding a portable floodlight for illumination at the construction site.
According to Section 6A(2)(a) of the Factories and Industrial Undertakings Ordinance, proprietors should provide and maintain a system of work that is safe and without risk to the health of the worker. Any proprietor who fails to do so is liable to a fine of $500,000 and to imprisonment for six months.
Section 6A(2)(c) of the ordinance also states that the proprietor should provide supervision to ensure workers' health and safety. Failure to do so could mean a fine of $500,000 and imprisonment for six months.
