The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:
The Mandatory Provident Fund Schemes Authority (MPFA) today (September 19) obtained an order in the District Court for payment of outstanding MPF contributions at about $180,000 against an employer. The MPFA pursued five claims in the Small Claims Tribunal for some $90,000 on behalf of 11 employees, who were owed MPF contributions by their employers.
The District Court today issued a judgment against Tin Kee Roasted Meat Limited. The defendant was ordered to pay the MPFA $186,009.38, being mandatory contributions in arrears and surcharges payable to 66 employees of the defendant.
At the Tribunal's hearing, defendant, Hin Sum Manpower Company Limited, did not dispute the amount claimed. The Adjudicator ordered it to pay the MPFA $48,252.78, being mandatory contributions in arrears and surcharges payable.
The other four defendants, Richmond Engineering Limited, Year Rich Limited, Lai Wai Shun Wilson formerly trading as Golden Hawk Food Manufactory and Henfair Remote Control Technology Research & Development Limited, did not appear. In their absence, the Adjudicator ordered them to pay the MPFA $32,604.44, $8,249.50, $399.50 and $288, being mandatory contributions in arrears and surcharges payable.
The amounts both awarded at the District Court and the tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court further ordered the defendant to pay costs of $930 and the tribunal ordered the defendants to pay $160, $126, $90, $60 and $76 respectively as costs in respect of the claims.
Hin Sum Manpower Company Limited previously pleaded guilty at Kwun Tong Magistracy to 30 counts and Year Rich Limited pleaded guilty to five counts of failing to make MPF contributions on time and were fined $84,500 and $13,000 respectively.
