Proprietor fined for violation of safety rule

    SDV Hong Kong Limited was fined $ 21,000 at Tsuen Wan Magistrates' Court today (August 2) for violation of the Factories and Industrial Undertakings Ordinance.  The prosecution was launched by the Labour Department.

     The case involved a fatal accident on April 29 last year at a loading bay of a warehouse in Kwai Chung. A worker was unloading a wooden box of goods from a container when the wooden box fell and hit him.

     According to section 6A(2)(a) of the Factories and Industrial Undertakings Ordinance, the proprietor must provide and maintain a system of work that is safe and without risk to the health of the employee. The penalty for not doing so is a fine of $500,000 and  imprisonment for six months.

     According to section 6A(2)(c) of the ordinance, the proprietor should also provide information and instruction to ensure the employee's safety and health. Failure to do so means a fine of $500,000 and imprisonment for six months.
