Employment for Principal Officials under the Accountability
System

The Advisory Committee on Post-office Employment for Principal Officials under the Accountability System (the Advisory Committee) received a request for advice from Ms Leung Oi Sie, Elsie who intended to accept the Chief Executive¡¦s appointment to be a member of the Constitutional Development Task Force (Task Force) in her personal capacity after leaving the office as Secretary for Justice with effect from 20 October 2005. The Advisory Committee has given its advice to Ms Leung in response to her request.
The Advisory Committee considered it laudable that Ms Leung is willing to serve as a member of the Task Force in her personal capacity following her resignation as Secretary for Justice, for only nominal remuneration.
The Advisory Committee has considered the information provided by Ms Leung and the assessment by the relevant Government offices. Since the Task Force is established within the Administration and chaired by the Chief Secretary for Administration, the Advisory Committee considered that there could not be any conflict of interest between Ms Leung¡¦s appointment as a member of the Task Force and her former role as Secretary for Justice; nor could there reasonably be a perception of such conflict if Ms Leung took up the appointment. The Advisory Committee further considered that since Ms Leung would serve as a member of the Task Force in her personal capacity and that the Department of Justice would continue to advise the Task Force on any legal issues, there would not be any conflict between her role as a member of the Task Force and that of the new Secretary for Justice.
