Employer fined for late payment of holiday pay

    Park Cheong Auto Engineering Limited has been fined $10,000 at the Fanling Magistrates' Courts for committing statutory holiday pay offences under the Employment Ordinance. The prosecution was launched by the Labour Department.

     The offences were detected followed a complaint by an ex-employee of the company in May this year. Subsequent investigation by the Labour Department revealed that the company did not pay holiday pay for five statutory holidays to the employee within the statutory time limit.

     According to Section 40 of the Employment Ordinance, an employee having been employed under a continuous contract for not less than three months immediately preceding a statutory holiday is entitled to holiday pay. Holiday pay should be paid to the employee not later than the day on which he is next paid his wages after that statutory holiday, whether the employee takes a holiday on the statutory holiday or on an alternative or substituted holiday.

     Any employer who fails to do so is liable to a maximum fine of $50,000.
