Company fined $10,000 for MPF offences

An employer was fined $10,000 at the Kwun Tong Magistracy today (October 29), after being convicted of an offence under the Mandatory Provident Fund Schemes Ordinance.

The defendant, International Credit Management Consultancy Limited, pleaded guilty to a charge of failing to enroll an employee in an MPF scheme. The defendant was fined $10,000 for the summons.

MPFA Wins 14 Claims for MPF Non-payment

In the Small Claims Tribunal today, the Mandatory Provident Fund Schemes Authority (MPFA) pursued 14 claims for some $357,000 on behalf of 41 employees, who were owed MPF contributions by their employers.

The defendants were Kam Wah International Engineering Limited, China Point Enterprise Limited trading as Hung To Hot Pot Sea Food Restaurant, Hui Hong Por trading as Yat Luen Engineering Company, Woo Chu Ki trading as Kei Shing Water Electric Engineering Company, The Wider International Trading Limited, Oi Man Kindergarten, Union Engineering & Trading Company Limited, Brilliant Sun Development Company Limited, Wong Ming Kong trading as Cheung Sing Tours Bus Company, Hin Sum Manpower Company Limited, Profit Leading Limited, Galaxy Award Limited trading as Golden Crown Restaurant, Yokozuna Japanese Noodle Shop Limited and Pilecon Engineering Berhad.

The defendant, Hin Sum Manpower Company Limited, pleaded guilty at Kwun Tong Magistracy earlier to six charges of failing to make MPF contributions on time and was fined a total of $21,000.

At today's hearing, Hui Hong Por trading as Yat Luen Engineering Company, Union Engineering & Trading Company Limited, Oi Man Kindergarten, Hin Sum Manpower Company Limited and Yokozuna Japanese Noodle Shop Limited did not dispute the amounts claimed. The Adjudicator ordered them to pay the MPFA the sum of $42,763.34, $22,840.04, $27,481.46, $19,727.80 and $9,566.44 respectively, being mandatory contributions in arrears and surcharges payable.

The other defendants, Kam Wah International Engineering Limited, China Point Enterprise Limited trading as Hung To Hot Pot Sea Food Restaurant, Woo Chu Ki trading as Kei Shing Water Electric Engineering Company, The Wider International Trading Limited, Brilliant Sun Development Company Limited, Wong Ming Kong trading as Cheung Sing Tours Bus Company, Profit Leading Limited, Galaxy Award Limited trading as Golden Crown Restaurant and Pilecon Engineering Berhad, did not appear at today's hearing. In their absence, the Adjudicator ordered them to pay the MPFA the sum of $49,823.17, $47,240.58, $33,293.02, $31,080.61, $22,762.50, $20,586.76, $15,244.31, $14,611.74 and $8,095.15 respectively, being mandatory contributions in arrears and surcharges payable.

The amounts awarded will be reimbursed to the relevant employees' MPF accounts as soon as they are received by the MPFA. Amounts of $330, $440, $170, $170, $120, $240, $130, $380, $280, $120, $280, $400, $270 and $100 were also awarded respectively as costs in respect of the claims.
